1. Introduction and Scope

By accessing or using the ARNEOX mobile application or website (www.arneox.com), you acknowledge that you have read, understood, and agree to be bound by these Terms of Use ("Terms") and our Privacy Policy.

These Terms constitute a legally binding agreement between you ("User") and ARNEOX YAZILIM ("ARNEOX", "we", "us").

ARNEOX is a health and fitness tracking application; it is not a medical device or healthcare provider. Always consult your doctor before starting a new exercise program.

If you do not agree to these Terms, do not use ARNEOX.

2. Eligibility

2.1 Age Requirement

You must be at least 16 years old to use ARNEOX. By creating an account, you confirm that you meet this age requirement.

Persons under 16 are not permitted to use ARNEOX. If we determine that a user is below this age threshold, we reserve the right to terminate the account immediately.

2.2 Legal Capacity

By using ARNEOX, you represent that you have the legal capacity to enter into this agreement and that the information you provide is accurate and complete.

3. Our Services

3.1 The ARNEOX Ecosystem

ARNEOX operates a multi-application ecosystem encompassing ARNEOX Fitness, ARNEOX Nutrition, and ARNEOX Running under a singular architecture. The platform currently offers:

• Workout Tracking: Exercise logging (sets, reps, weight, RPE/RIR), personalized training programs, database of 765+ exercises.
• Body Tracking: Body measurements, weight and body fat tracking, progress photos, BMI/BMR calculations.
• Progress Analytics: Performance charts, personal records, weekly/monthly statistics.
• AI Backend (ARNEOX AGENT): A continuous AI layer integrated across the ecosystem. Pro includes passive backend-level AI orchestration, while live ARNEOX AGENT interaction is reserved for Pro+.
• Health Integration: Apple Health and Google Fit sync.

3.2 Unified Subscription Tiers

ARNEOX operates on a "Single Account, Unified Subscription" model encompassing three tiers: Free, Pro, and Pro+. A single subscription grants corresponding access rights across all current and future ARNEOX applications. Advanced analytics and expanded usage capacity are available in paid tiers. Live ARNEOX AGENT interaction is exclusively available to Pro+, while Pro includes passive backend-level AI capabilities without direct user interaction.

3.3 Technical Requirements

Using ARNEOX requires an internet connection and a compatible mobile device (Android or iOS). Availability of specific features may vary depending on your device and operating system version.

4. Single Account System

4.1 Account Creation

You access all applications within the ARNEOX ecosystem (fitness, nutrition, running, etc.) with a single account. You can create an account using:

• Email address and password registration
• Google Sign-In (OAuth 2.0)

Each user may only create one account; creating multiple accounts is prohibited.

4.2 Account Security

You are responsible for the security of your account. You are obligated to keep your password confidential, use a strong password, and immediately notify security@arneox.com if you suspect any unauthorized activity. You are responsible for all activities that occur under your account.

5. Health and AI Diagnostic Disclaimer

ARNEOX and the ARNEOX AGENT are not medical devices and do not provide medical, clinical, or nutritional diagnosis, treatment, or therapy.

• AI Outputs: Training recommendations, diet plans, and calculations (estimated 1RM, calorie burn, BMI) generated by our algorithms or the ARNEOX AGENT are for general informational purposes only. Large Language Models (LLMs) and algorithms can sometimes produce inaccurate or incorrect results.
• Assumption of Risk: Exercise carries an inherent risk of injury or serious health issues. You are solely responsible for consulting a medical professional before following any AI-generated program.
• Medical Consultation: You are strongly advised to consult a doctor before starting any exercise or nutrition program suggested by ARNEOX, especially if you have any pre-existing or chronic health conditions. In particular, please seek medical advice if you have any of the following:
  • Cardiovascular disease or a history of heart problems
  • Lung or respiratory conditions (including asthma)
  • Spinal, joint, or musculoskeletal conditions
  • Recent surgical procedures or injuries
  • Pregnancy or post-natal recovery
  • Neuromuscular disease
  • Any other ongoing or chronic medical condition
• ARNEOX does not guarantee specific results (weight loss, muscle growth, strength gains, etc.).

Stop Immediately: If you experience chest pain, dizziness, or difficulty breathing during exercise, stop the activity immediately and seek emergency medical help.

6. User Obligations

6.1 Acceptable Use

By using ARNEOX, you agree to comply with all applicable laws, treat other users with respect, and provide accurate information. You may use the Service only for personal, non-commercial purposes.

6.2 Prohibited Activities

The following activities are strictly prohibited:

Harmful or Dangerous Conduct

• Bullying, harassing, stalking, or threatening other users
• Uploading content that promotes violence, terrorism, self-harm, or dangerous health practices
• Distributing illegal content or content that infringes third-party rights

Unauthorized Access & System Integrity

• Reverse engineering, decompiling, or attempting to extract source code from ARNEOX
• Accessing the service via bots, scrapers, automated scripts, or API abuse
• Attempting to gain unauthorized access to other users' accounts or data
• Testing, scanning, or probing for security vulnerabilities without prior written authorization

Fraudulent & Deceptive Activity

• Creating multiple accounts to abuse free tiers, referral systems, or feature limits
• Impersonating ARNEOX, another user, or any other person or entity
• Misrepresenting your identity, qualifications, or health data
• Organized manipulation of ratings, reviews, or community rankings

Spam & Commercial Misuse

• Sending unsolicited commercial messages or spam to other users
• Using ARNEOX for any commercial activity without our prior written consent
• Uploading or linking to affiliate URLs, multi-level marketing schemes, or promotional content

Other Prohibited Uses

• Promoting illegal substances, unapproved supplements, or dangerous health claims
• Uploading hateful, obscene, or otherwise harmful content
• Any activity that undermines the integrity, availability, or security of the ARNEOX platform

Users who violate these rules may face warnings, temporary suspension, or permanent account termination. Illegal activities will be reported to the appropriate authorities.

7. Intellectual Property

7.1 ARNEOX's Rights

All intellectual property rights in the ARNEOX application, including source code, designs, logo, brand, exercise database, algorithms, and all content, belong to ARNEOX and are protected by international copyright, trademark, and other intellectual property laws.

7.2 License to User

You are granted a limited, non-exclusive, non-transferable, revocable license to use ARNEOX for personal, non-commercial purposes. You may not copy, distribute, modify, or sublicense the software to third parties.

8. User Content

8.1 Ownership

You retain ownership of all content you upload to ARNEOX (workout logs, profile information, photos, etc.). ARNEOX does not claim ownership rights over your content.

8.2 License

By uploading content, you grant ARNEOX a non-exclusive, worldwide, royalty-free license to store, process, and display your content for the purpose of providing the Service. We do not use your content for advertising or sell it to third parties. Your data may be used in anonymized and aggregated form to improve our internal AI models, as described in our Privacy Policy. All users (Free, Pro, and Pro+) can opt out of anonymized model-training use and Agent data access at any time from in-app privacy settings without losing access to any part of the Service.

8.3 Content Standards

You are responsible for the content you upload. Uploading illegal, harmful, obscene, or rights-infringing content is prohibited. We reserve the right to remove content that violates these standards without prior notice.

8.4 Feedback

Any feedback, suggestions, or ideas you submit regarding ARNEOX (through in-app tools, support channels, or any other means) will not be treated as confidential. ARNEOX may freely use, incorporate, or disclose such feedback for any purpose without obligation, compensation, or attribution to you.

9. Subscriptions and Payments

9.1 Public Plans and Pricing

ARNEOX currently provides the following publicly offered plans:

• Free
• Pro Monthly: USD 5.99 per month
• Pro Annual: USD 49.99 per year (billed once annually)

Unless otherwise required by applicable law, listed prices may exclude taxes, duties, and currency conversion fees imposed by your payment provider or app store.

A Pro subscription is unified across the ARNEOX ecosystem. One active Pro subscription unlocks Pro entitlement for ARNEOX Fitness, ARNEOX Nutrition, and ARNEOX Run under the same account.

9.2 Feature Matrix (Free / Pro / Pro+)

Usage limits and response SLAs are operational targets, not strict guarantees, and may vary during outages, force majeure events, fraud prevention checks, or abuse investigations.

9.3 Payment Processing

Payments are processed through Google Play Store (Android). iOS support is planned for a future release. We do not directly store your credit card information; all payment transactions are handled by these platforms.

9.4 Auto-Renewal and Cancellation

Subscriptions automatically renew at the end of each billing period. You must cancel at least 24 hours before the renewal date.

Cancellation methods:

• Android: Google Play Store → Subscriptions → ARNEOX → Cancel
• iOS (coming soon): Apple ID → Subscriptions → ARNEOX → Cancel

After cancellation, your premium access continues until the end of the current period. Your workout logs and data remain accessible under the free plan.

9.5 Refund Policy

Refunds are primarily governed by the applicable platform's (Google Play) refund policy. For documented technical issues or billing errors, contact billing@arneox.com.

EU/EEA Users – Right of Withdrawal: You have a 14-day right of withdrawal before digital content delivery begins. Once you access the content, you waive this right.

9.6 Price Changes

Price changes will be communicated to existing subscribers 30 days in advance via email. Current subscriptions continue at the existing price for the remaining billing period.

10. Third-Party Services

ARNEOX integrates with various third-party services to deliver the Service (Google Sign-In, Apple Health, Google Fit, payment processors, analytics tools, etc.).

When using these services, you are also subject to the respective third party's own terms. We do not control and are not responsible for third-party service availability, accuracy, or privacy practices.

ARNEOX may contain links to third-party websites. We cannot be held responsible for the content or security of these external sites.

11. Disclaimers and Limitation of Liability

11.1 Service Delivery and Algorithmic Outputs

ARNEOX is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind. We do not guarantee that the Service, including ARNEOX AGENT outputs, will be uninterrupted, error-free, or fit for a particular purpose.

AI Output Liability Limitation: To the maximum extent permitted by law, ARNEOX is not liable for physical, psychological, or material damages resulting from reliance on AI-generated training and nutrition recommendations. Users accept full responsibility for the risks associated with following such recommendations.

11.2 Liability Cap

To the maximum extent permitted by applicable law, ARNEOX is not liable for indirect, incidental, special, or punitive damages (including loss of profits, data, or reputation).

In any liability case, ARNEOX's total liability is limited to the amount you paid to ARNEOX in the 12 months preceding the claim, or €100, whichever is greater.

These limitations do not apply to: death or personal injury caused by negligence or gross misconduct, intentional misconduct, and liabilities that applicable law prohibits from being limited.

11.3 Indemnification

You agree to indemnify ARNEOX against all claims, damages, and expenses arising from your use of the Service in violation of these Terms, infringement of third-party rights, or content you upload.

12. Account Suspension and Termination

12.1 By ARNEOX

We reserve the right to suspend or permanently terminate your account in cases of Terms violations, suspected fraud, or illegal activities. Email notification will be provided where possible.

12.2 By User

You may close your account at any time using the in-app "Delete Account" button or by emailing support@arneox.com.

A 30-day waiting period applies after an account deletion request. During this period, you can restore your account by logging in. After 30 days, your data is permanently deleted (except for legal obligations — see Privacy Policy for details).

Important: Deleting your account does not automatically cancel your subscription. You must separately cancel any active subscription through the platform.

13. Dispute Resolution

13.1 Initial Contact

In case of any dispute, we encourage you to contact us directly before initiating legal proceedings. Most issues can be resolved through good-faith dialogue.

13.2 Governing Law and Exclusive Jurisdiction

These Terms, and any non-contractual obligations arising out of or in connection with them, are governed exclusively by the substantive municipal laws of the Republic of Turkey.

The Parties agree that the Courts and Execution Offices of Istanbul (Anatolian Courthouse) shall have exclusive jurisdiction to hear and determine any dispute arising out of or in connection with this Agreement. This exclusive jurisdiction clause does not override the right of consumers in the EU/EEA to bring legal action in the courts of their country of habitual residence under Regulation (EU) No 1215/2012 (Brussels I bis).

The parties may also opt for voluntary arbitration under Istanbul Arbitration Centre (ISTAC) rules.

13.3 EU/EEA Users

Users accessing from the EU/EEA may use the EU Online Dispute Resolution (ODR) platform: https://ec.europa.eu/consumers/odr. Mandatory EU consumer protection rights remain applicable in all cases.

14. Changes to These Terms

We may update these Terms from time to time.

For material changes (affecting your rights or obligations), we will provide 30 days' advance notice via email to your registered address and display an in-app notification upon your next login.

Continued use of ARNEOX after updated Terms take effect constitutes your acceptance of the changes. If you do not agree with the changes, you may stop using the Service and delete your account.

15. Corporate Relocation

ARNEOX may relocate its corporate entity to a different country in the future. If such a change is planned, we will inform all users at least 30 days in advance via their registered email addresses. Any such relocation will not diminish your existing privacy rights.

16. Multi-Jurisdiction Provisions

EU/EEA Users

GDPR rights are fully applicable. The 14-day right of withdrawal (before digital content delivery begins) and mandatory consumer protection rights take precedence over these Terms.

United States Users

CCPA/CPRA rights apply for California users. We do not sell or share your personal information for cross-context behavioral advertising.

Brazil Users

LGPD (General Data Protection Law) rights apply. Mandatory consumer protection rights are preserved.

Turkey Users

KVKK (Personal Data Protection Law) is fully applicable. Disputes may be directed to Istanbul Consumer Arbitration Boards or Consumer Courts.

17. General Provisions

Severability: If any provision of these Terms is found invalid, the remaining provisions continue in full force and effect.

Waiver: Failure to exercise any right does not constitute a waiver of that right.

Assignment: You may not assign your rights under these Terms without our written consent. ARNEOX may assign these Terms in the event of a merger or acquisition.

Entire Agreement: These Terms and the Privacy Policy constitute the entire agreement between you and ARNEOX.

Force Majeure: We are not liable for inability to provide the Service due to circumstances beyond our control, such as natural disasters, war, pandemics, government actions, or communication failures.

Electronic Communications Consent: By using ARNEOX and providing your email address, you consent to receiving all communications from us electronically — including notices, updates, and service-related messages — via email or in-app notifications. Electronic communications satisfy any legal requirement that such communications be in writing, to the extent permitted by applicable law.

19. Export Controls

The ARNEOX application and related software may be subject to applicable export control laws and regulations. By using ARNEOX, you confirm that you are not located in a country subject to a relevant trade embargo or sanctions, and that you are not named on any government-prohibited or restricted party list. You are responsible for complying with all applicable export and import laws and regulations in your jurisdiction.

20. EU Digital Services Act (DSA)

If you are accessing ARNEOX from a country within the European Economic Area (EEA) and believe any content on our platform is illegal or violates these Terms, you may report it by emailing legal@arneox.com with the subject line "DSA Content Report".

When we remove content or take action against an account for a Terms violation, we will notify the affected user with the reason for the action and information about how to appeal through our internal complaint-handling process.

ARNEOX’s designated point of contact for EU authorities and the European Commission regarding the Digital Services Act is: legal@arneox.com.

We currently serve fewer than 45 million monthly active users in the European Economic Area.

By using ARNEOX, you acknowledge that you have read, understood, and agree to these Terms of Use.
